Terms of Service

1. Agreement to terms

By accessing and using PathTo80, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. Rorisang Pty Ltd (trading as PathTo80) reserves the right to modify these terms at any time. Changes are effective when posted. Your continued use means acceptance.

2. Service description

PathTo80 is an adaptive learning platform designed for Grade 7 students in South Africa. The service includes:

• Daily learning blocks with curriculum-aligned questions
• Spaced-repetition algorithm to optimise learning
• Real-time parent dashboard showing student progress
• Access across web and mobile devices

PathTo80 is a supplementary learning tool and is NOT a substitute for classroom instruction, professional tutoring, or qualified education.

3. Subscription and pricing

PathTo80 operates on a monthly subscription model:

• Price: R99 per month per student
• Billing: charged monthly on the anniversary of signup via PayFast
• Currency: all prices are in South African Rand (ZAR)
• One student per subscription: a single subscription covers one child only. You may create multiple subscriptions for multiple children
• No setup fee: there is no initial charge

4. Free trial

New users receive a 7-day free trial. At the end of the trial period, your subscription will automatically convert to paid. You must provide valid payment information to access the free trial. No charge will be made until the trial ends.

5. Refund policy

We offer a 7-day refund policy. If you are not satisfied with PathTo80, you can request a full refund within 7 days of your first payment. After 7 days, no refunds are offered, but you can cancel anytime and access continues until the end of your paid period.

6. Cancellation

You may cancel your subscription at any time without penalty. Upon cancellation:

• You retain access to your student dashboard until the end of your current paid period
• No refund is issued for the current month (unless within the 7-day refund window)
• Your student's data will be retained for 30 days after cancellation, during which you can download progress reports
• After 30 days, all data is permanently deleted

To cancel, log into your account and select “Cancel subscription” or email hello@pathto80.app.

7. Payment and billing

Payment is processed by PayFast, a South African payment processor. By providing payment information, you authorise PayFast to charge your account monthly. You are responsible for maintaining accurate payment details.

• Failed payments: if payment fails, we will attempt to recharge within 3 days. If payment continues to fail, your account will be suspended
• Payment updates: you can update your payment method in your account settings
• Billing disputes: contact PayFast directly for payment disputes

8. Account creation and responsibility

To use PathTo80, you must:

• Be a parent or legal guardian of the student using the service
• Provide accurate email and account information
• Keep your password confidential and secure
• Notify us immediately of unauthorised access
• Agree to the Privacy Policy and these Terms

You are responsible for all activity on your account. Rorisang Pty Ltd is not liable for unauthorised access resulting from your failure to keep your password secure.

9. Acceptable use

You agree NOT to:

• Share your login credentials with anyone else
• Use PathTo80 for any purpose other than your child's education
• Attempt to gain unauthorised access to PathTo80 systems or data
• Reverse-engineer, decompile, or copy the app or its content
• Use PathTo80 to commit fraud, harassment, or any illegal activity
• Upload viruses, malware, or harmful code
• Interfere with the operation or security of PathTo80
• Create multiple accounts to evade fees or restrictions

Violation of acceptable use terms will result in immediate account termination without refund.

10. Content and intellectual property

All questions, lessons, and learning materials on PathTo80 are authored by Rorisang Pty Ltd and are protected by copyright. You may not copy, distribute, modify, or reproduce any content without permission.

Student-generated content (answers, progress data) belongs to you. You grant PathTo80 the right to use aggregated and anonymised learning data to improve the service.

11. Curriculum alignment and limitations

PathTo80 questions are aligned with the South African Grade 7 curriculum (CAPS). However:

• PathTo80 is a supplementary learning tool only
• It is NOT a substitute for classroom instruction
• It does NOT replace a qualified teacher or tutor
• Your child should continue attending school and working with their teachers
• Use PathTo80 to supplement, not replace, formal education

We do not guarantee specific grades or exam outcomes. Educational results depend on many factors including classroom engagement, teacher quality, and student effort.

12. No warranties

PathTo80 is provided “as is” without warranties of any kind, either express or implied. Rorisang Pty Ltd does not warrant that:

• The service will be uninterrupted, error-free, or secure
• Your child will achieve any specific academic outcome
• The app will be compatible with all devices or internet connections
• Data will never be lost or corrupted

13. Limitation of liability

To the maximum extent permitted by South African law, Rorisang Pty Ltd shall not be liable for:

• Any indirect, incidental, or consequential damages arising from use of PathTo80
• Loss of data, income, or educational opportunity
• Service interruptions, server downtime, or technical failures
• Actions or inactions of third parties (e.g., PayFast, Supabase)
• Any claim relating to school performance, exam results, or grade outcomes

Our total liability for any claim shall not exceed the amount you paid in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Rorisang Pty Ltd from any claims, damages, or costs arising from:

• Your breach of these Terms
• Your use of PathTo80 in violation of law
• Your negligence or misuse of the service
• Any third-party claims relating to your account

15. Service availability and maintenance

We aim to keep PathTo80 available 24/7, but we do not guarantee uptime. We may suspend or terminate the service at any time for maintenance, security, or business reasons. We will provide notice when possible. No refunds will be issued for planned or unplanned downtime.

16. Data and privacy

Your use of PathTo80 is governed by our Privacy Policy. By accepting these Terms, you also accept the Privacy Policy. If there is a conflict between these Terms and the Privacy Policy, the Privacy Policy controls data handling.

17. Termination

Rorisang Pty Ltd may terminate your account at any time if you:

• Violate these Terms of Service
• Engage in fraud or illegal activity
• Fail to pay your subscription fees
• Misuse or abuse the service

Upon termination, your access to PathTo80 will be revoked. No refund will be issued except as required by the refund policy.

18. Governing law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

19. Entire agreement

These Terms of Service, along with the Privacy Policy, constitute the entire agreement between you and Rorisang Pty Ltd regarding your use of PathTo80. Any prior agreements, understandings, or negotiations are superseded by these Terms.
